COUNTY COMMISSION DIRECTS STAFF TO FURTHER REVISE PROPOSEDNUISANCE ORDINANCE AND WILL RECONSIDER IN DECEMBER
Reno, Nevada. October 29, 2009. At their regularly scheduled meeting yesterday, Washoe County Commissioners directed planning staff to make specific revisions to a proposed nuisance ordinance and return on December 8th for a first reading of said ordinance with a second reading and possible adoption on January 12, 2010. Both readings would occur during the public hearing portion of the County Commission meeting, scheduled to begin no earlier than 6:00 p.m. on both days.

The second reading yesterday of the proposed ordinance amending the Washoe County Code at Chapter 50 sought to amend unlawful acts for operating a motorcycle or an off-road vehicle and add a whole new part for nuisance codes, to include purpose and scope, definitions, unlawful acts and enforcement, public nuisances, and modifications to public nuisances. The new nuisance code reflects current County and State laws which regulates nuisance and was the result of direction by the County Commission to consolidate these existing laws into a single Code chapter. The draft ordinance was refined and focused after two years of work by a citizens working group representing various parts of the unincorporated areas of Washoe County ranging from Incline Village in the south to Cold Springs and Gerlach in the north.

After receiving two hours worth of input from citizens attending yesterday’s meeting as well as other input received via phone calls and the county’s website, County Commissioners directed planning staff to modify specific items in the proposed ordinance, to include amending the definitions related to “public view” and “vehicles”, removing the proposed two vehicle limit for junk vehicles but strengthening proposed regulations which would prohibit the storage of any junk vehicle in the public view, and completely removing Section 8 which address potential nuisance modifiers. The Commission accepted the majority of the remaining ordinance sections, including Section 1 which makes it unlawful to operate a motorcycle or an off-road vehicle on public or private land within 1,000 feet (instead of 500 feet) of any residence owned or occupied by another.

A revised proposed ordinance will be posted at Nuisance as soon as it is completed, by December 3rd at the latest.
